Downloading of video clips and image data
This website is intended for the media, tourist agents, and public organizations that understand the purposes of Oita Prefectural Tourism Association (“Tourism Oita”) and agree to publicize and enhance recognition of Oita Prefecture as a must-visit tourist site.
When you download any video clips and image data from this website, you need to come into line with the following rules of downloading (“the Rules”) and register as a member.
Personal information obtained through the membership registration shall be treated appropriately pursuant to the Personal Information Protection Policy and the Personal Information Handling Policy in the Japan Online Media Center, which are stipulated by Oita Prefecture. Registered users (“the Users”) shall agree that their personal data are subject to these polices.
Rules of downloading (Terms and Conditions of Membership)
1：Methods and purposes for data usage
The Users may use data, for example, video clips, and images distributed on this website, (the “Content”) without breaching the Rules. In the Rules, the word “use” means alternation and compilation conducted within the range defined below, broadcasting and publication through the media including streaming and downloading, as well as replication and distribution in the form of the electronic media including DVDs and tangible media such as pamphlets.
- Resolution adjustment appropriate for use
- No distribution of replicated data to third parties (when it is distributed on the Internet, only streaming is available for third parties; however, the Content should be processed to avoid downloading).
- Adding a simple edition to the Content, such as trimming, inversion, resizing or text addition, and segmenting of a video clip; and
- Similar edition of the Content to the extent necessary to use
Downloading and using of the Content is permitted only when it is used for the purpose to raise the demand of travel to and the number of tourists to Oita Prefecture through advertising its beauty (hereinafter called “the Purpose of Use”). Using the Content, however, is not permitted when Oita Prefecture deems a method of using data inappropriate or when the method violates any of the prohibitions stipulated in paragraph 6 of the Rules.
2：The Users of the Content
The Users of the Content means the media, tourist agents, and public organizations that understand the aim of Oita Prefecture as the provider of the Content and agree to cooperate to advertise the appealing points of Oita Prefecture
3：Types of the Content
Data types available on this website are as follows:
Video: HD size (1920 × 1080 pixels)
Image: 4000 × 2670 pixels / 2000 × 1335 pixels / 640 × 427 pixels
4：Usable period for the Data Material
No period of use shall be established for the Data Material such as pamphlets, videos and photographs presented on this website. However, Users of the Data Material on this website shall be deemed to have used the Data Material after understanding that part of information may be modified through updating, etc.
5：Copyright
Tourism Oita retains the copyright in every Content and has already obtained permissions related to portrait rights necessary to use the Content on this website.
The Content on this website is protected by the Copyright Act and agreements of the relevant countries, including various kinds of works and their derivative works, i.e., music, paintings, drawings, photographs, programs, edited works, and database. If any of the abovementioned works is converted, replicated, transmitted, broadcasted, distributed, lent, translated, or altered in a way unauthorized in the Rules without permission from Oita Prefecture and/or other relevant right holders, such activities constitute copyright infringement, and a person who conducts any of such activities may be forced to bear a civil or criminal responsibility.
6：Prohibitions
The following acts are prohibited unless Oita Prefecture agrees with the Users in writing individually. If the Users breach any of the provisions provided in this section, Tourism Oita may suspend the use of the Content by such Users temporarily and request them to collect and destroy the Content, which they have downloaded and used, at their own expense. If the Users violate any of the Rules, slander Oita Prefecture’s reputation indirectly, or give damages to the Prefecture, it may seek compensation for damages from such Users.
- Intentionally inputting incorrect information in a membership registration form on this website to obtain the Content
- Sharing the Content downloaded from this website with third parties who are not members of this Website or do not agree to the Rules
- Using the Content for any purpose other than the Purpose of Use
- Using the Content after the usable period provided in paragraph 4 of the Rules
- Using the Content in a way out of the scope stipulated in paragraph 1 of Rules, for example, integrating the Content with other video clips or images; retrieving CG to the Content; or editing, processing, presenting, or introducing the Content in a way that original objects seen in the Content are not recognized or recognized differently
- Distributing the original or processed Content in a way in which the Content can be traded independently (irrespective of whether such distribution is for sales/lease, or for free); distributing image video clips and electric data sets for sales purpose; distributing DVDs and pamphlets to advertise or promote products and services provided by the Users themselves; sharing the Content with third parties on the Internet as a material; or other similar acts
- Acts that generate unfairness or misunderstanding; acts that damage Tourism Oita ’s reputation, confidence, or objects seen in the Content or other relevant third parties; acts that violate the laws of Japan, other applicable laws and public policy through use of the Content on this website.
- When it is difficult to determine whether a particular act falls under any of the abovementioned prohibitions, you shall contact us to inquire through the link specified in paragraph 8.
7：Disclaimer
The Users shall take responsibilities for their own usage of the Content.
Oita Prefecture exerts the utmost effort to ensure the accuracy of the information provided in this website; however, the information may include unavoidable inaccuracies or misprints due to technical issues. In using published materials, you are encouraged to verify them in other media in advance. In addition, Tourism Oita may at any time cease or suspend provision of the Content on this website without advance notice. Oita Prefecture and the copyright holders of the Content shall take no responsibility for direct or indirect damages incurred by the Users due to the abovementioned cessation or suspension, or the usage of the Content in this website, or for disputes occurred between the Users and a third party.

11：Governing law and jurisdiction
The Rules shall be subject to the laws of Japan regardless of conflict-of-laws principles. Disputes arising from or related to the Rules shall be resolved in the Oita District Court, which is agreed as the exclusive jurisdiction in the first instance.
